The Patriot Act, is it just Unconstitutional or does it really do what the title suggests?

First read that about the Patriot Act its a summary for those who do not read legalese. Or read the below link from the library of congress website. (Currently obtaining the actual written act is eluding me. Under the freedom of information act you can get it sent to your home in its entirety.)

Please note I actually do read summaries of acts passed in Congress, as it is my Constitutional right. And if I do not understand the summary I request for the bill in its entirety. By law the government has to provide uncensored public documents. Since bills and laws are not classified and if they were we would have a huge problem, nothing should be black boxed. If you recieve a bill or law that was black boxed contacting your governor or congressman about the issue is advisable. Other than certain UCMJ laws there is no law that is marked higher than General. Which every citizen has.

 

Now all that is out of the way and I think I am actually giving good information so far, I believe the Patriot Act does infringe on US Citizen Rights and the American Ethos. For example, if you are a national and one of your family members gets charged with domestic terrorism or a family member is charged with International Terrorism. You loose eligibility of all government assistance. I did not see the word Immediate so that is saying to me that any family member. That is if you have knowledge of the activity or not. Also refugees from other countries that is publicly outspoken against the American Government and Policies is actually not allowed to receive a Visa of any kind or diplomatic immunity. Also this Act broadens the term terrorist, which is not a bad thing but there are some things in the list of actions that is in the “Grey Area”. Also the verbage is so loose that  it can be left to interpretation. Which means anyone can be labeled as a terrorist. And if you are labeled as a terrorist indefinite  imprisonment without the chance to get a trial with a jury of your peers. And there has been recorded cases of innocent people getting detained. Also NSL’s or roving wiretaps have been found to be unconstitutional. There are so many more arguments, but I want to know everyone’s opinions.

    The Patriot Act goes too far in attempting to protect America, violating the Constitution and civil liberties. In particular, it goes too far by allowing indefinite detentions of immigrants; searches of homes and businesses without permission or knowledge of those being searched; expanded powers of the FBI to search telephone, email, and financial records without a court order; and the expanded access of law enforcement agencies to government records. Federal courts have ruled at least one provision of the act as unconstitutional.

    This should be an eye opener for anyone who is for approval expanded FBI authority.

    Lawyers Call for Patriot Act Oversight. A letter from the President of the American Bar Association to Members of Congress considering Patriot Act renewal states that the ABA is “concerned that there is inadequate Congressional oversight of government investigations undertaken pursuant to the Foreign Intelligence Surveillance Act to ensure that such investigations do not violate the First, Fourth, and Fifth Amendments to the Constitution.”

    EPIC FOIA Documents Show Possible Patriot Act Abuses. Documents obtained by EPIC under the Freedom of Information Act describe thirteen cases of possible FBI misconduct in intelligence investigations. The documents were released by the Bureau in response to an EPIC open government request for information about the FBI’s use of provisions of the PATRIOT Act. EPIC has written a letter to the Senate Judiciary Committee highlighting the need for the Attorney General to report to Congress on potentially unlawful intelligence investigations.
